The district administrative court of Kiev rejected the public organization “Institute of legal policy and social protection” the claim about recognition illegal application “of the organization of Ukrainian nationalists” (OUN, the organization banned in Russia) to Kiev city administration about the “public patrols” in Kyiv on 9 may to prevent the action “Immortal regiment”. On Tuesday, may 8, reports “Interfax”.
An application to the city administration filed a “Voluntary movement of the OUN”. The plaintiff asked the court to remove obstacles to the realization of the right to freedom of peaceful Assembly (street procession “Nobody is forgotten! Nothing is forgotten!”, scheduled for may 9 from 10:00 to 16:00 local time (coincides with Moscow)).
Also the “Institute of legal policy and social protection” asked the court to declare the application “Volunteerism OUN” the implementation of a “public street” in the center of Kiev on may 9 to “prevent the collaborationist action “Immortal regiment”” not conforming to the requirements of article 39 of the Constitution (“citizens have the right to assemble peacefully without arms and to hold meetings, rallies, processions and demonstrations”).
The court fully dismissed the claim. “Volunteerism OUN” urged his supporters to begin a patrol on the morning of may 9 at the metro station “Arsenalnaya” in Kiev center.
The Director of “Institute of legal policy and social protection”, the lawyer Elena Berezhnaya said “Strenia” that according to the court, activists “Voluntary movement of the OUN” does not have the right to inspect the portraits, which will be borne by the participants of the action “Immortal regiment”, and look at them forbidden symbols (ban and St. George ribbons). “They have no right to apply any measures affecting the personal integrity of participants of the action and was on this account warned today by the court. The court clearly emphasized that the protection order during the action rests with the police,” she said.
On may 8 the counselor of the interior Minister of Ukraine Zorian Shkiryak said on the upcoming may 9 provocations “of the Russian special services” in the country. In this regard, he warned that Ukraine is “illegal use of Communist and Nazi symbols is prohibited,” and “for the use of the symbols of the Russian terror (the so-called St. George ribbons, and so forth) provides for strict administrative liability”.
