Russia has defended the right to “Stolichnaya” vodka

Russia managed to defend in court the right to brands of vodka Stolichnaya and Moskovskaya in Austria. As reported TASS, the court of appeal of Linz has confirmed the right of the Federal state enterprise “sojuzplodoimport” for these trademarks in the country.

Company: Spirits International B. V., registered in Luxembourg, is now forbidden to use them. In addition, the company is obliged to compensate to the Russian side lost profits — the income that she received from the illegal use of trademarks.

As specified in the “Sojuzplodimport”, Spirits International is obliged to cease the supply of products Stolichnaya and Moskovskaya to the Austrian market being second in Europe in terms of sales of vodka Stolichnaya.

Earlier, Dutch courts have already declared “sojuzplodoimport” the legitimate right holder of the trademark. But in February of this year, the Linz court of appeals refused to recognize this decision. In the Supreme court of Austria has managed to achieve reconsideration of the case, the court of appeal decision was quashed, the case was returned for retrial. It was particularly specified that the decisions of the Dutch courts is mandatory in Austria.

“Sojuzplodimport” evaluated this decision as a precedent, which confirmed the decision of the Dutch court enforceable in the other EU countries.
