Russia attacked and captured Ukrainian military ships in international waters of the Black sea, said the Ministry of the Republic on the temporarily occupied territories and internally displaced persons in Ukraine.
According to in Kiev, the ship “Berdyansk”, “Nikopol” and tug “Yana Kapu” were outside the Maritime boundary line, “which is temporarily not controlled by Ukraine as a result of the occupation of the territory of the Autonomous Republic of Crimea”. Also, the report published map, which, according to the Ministry, shows the coordinates of the ships at the time of arrest and attack.
The Ministry emphasizes that, under the UNCLOS, warships enjoy in the high seas complete immunity from the jurisdiction of any state also, whose flag they walk. All the detained Ukrainian soldiers are under the protection of international humanitarian law, particularly the Geneva Convention relative to the treatment of prisoners of war.
“Those who organized and committed the act of aggression and defiant violations of international humanitarian law, should be mindful of the inevitability of punishment. The experience of modern international conflicts proves that the “sword” of justice ultimately gets not only the “pawns” and “cogs”, but even heads of state”, — concluded the Ministry.
On 25 November, the FSB has reported that three Ukrainian military ship violated the sea border and dangerous maneuver in Russian waters. Russian border guards detained them together with 24 sailors. Ukraine’s Navy said that the court committed a planned transition from Odessa to Mariupol, which was announced in advance. President Petro Poroshenko has imposed on Ukraine martial law.
According to the FSB, Ukrainian ships entered the territorial waters of Russia, which was established even before the inclusion of Crimea in structure of the country. Kiev does not recognize the Russian status of the Peninsula and the waters near it accordingly, and also considers illegal the construction by Russia of a bridge across the Kerch Strait including from the point of view of Maritime law.
