The Swiss Federal Supreme court defined the conditions under which the international Olympic Committee (IOC) will be able to appeal the decision of the court of arbitration for Sport (CAS) to justify 28 the Russian athletes. The words of the President of the court Peter Josie cites RIA Novosti.
“Appeal to the Swiss Federal Supreme court is possible only on limited grounds, such as lack of competence, infringement procedures, for example, violation of the right to a fair trial, as well as the incompatibility of decisions with public order,” said Josie.
On 1 February, the IOC expressed disappointment in response to the CAS decision on the abolition of the lifetime suspensions of the Russians. Then the representatives of the Committee announced the intention to appeal to the Swiss Federal Supreme court after receiving the reasoning part. The next day, the IOC member Adam Pengilly stated that the CAS decision allowed “the deceivers and thieves to triumph”.
The Olympics will be held from 9 to 25 February in South Korea’s Pyeongchang. The Russian athletes at the Games-2018 will be performing under the Olympic flag and the special status of “Olympic athlete from Russia.”
