The heads of state-owned companies fall into the list of possible corrupt

The Ministry of justice proposed to expand the list of officials in the case of an offence falling under article 285 of the Criminal code of the Russian Federation (the criminal code), “Abuse of power”. In particular, there is suggested to include heads of public corporations. It is reported by RBC with reference to the Federal portal of projects of normative legal acts.

Passport of the draft law published on the portal site, though the full amended text is missing. The passport contains information about the discussed innovations: it is proposed to add to the list “persons performing organizational-administrative or administrative-economic functions in commercial companies, shares in authorized capital of which is directly or indirectly owned by the Russian Federation or a subject of the Russian Federation”.

On the website stated that a discussion will be held from 6 to 20 August, and, if the bill is approved, these changes will apply not only to article 285 of the criminal code, but also on the entire Chapter 30 of the criminal code “Crimes against state authority, interests of state service and service in local governments”.

In the current wording of article 285 of the criminal code under officials refers to “persons permanently, temporarily or on special authority exercising the functions of representative government” and the people who perform organizational or administrative-economic functions in state bodies, joint-stock companies, local authorities and other organisations a controlling stake in which belongs to the Russian Federation and its constituent entities.

In 2017 closed the case against the former head of the state Corporation “RusHydro” Evgeny DoD, he was accused of illegal premiums yourself. In September 2017 the DoD has released from-under house arrest when he repaid the damage inflicted to the company.
