The Federal security service (FSB) and the Ministry of internal Affairs (MVD) of Russia has opposed the inclusion in the criminal code a separate article on torture as misconduct. On Tuesday, January 29, reported on the website of the Council on human rights (HRC).
Earlier with the initiative about entering into the criminal code a new article made in the HRC. However, the FSB felt that torture committed by public officials, can be qualified under item “d” of part 2 of article 117 (“Torture torture”) or under the item “and” parts of 3 articles 286 (“Excess of powers of office with application of violence”) of the criminal code.
The interior Ministry also listed articles of the criminal code, which already implies the punishment for acts corresponding to the concept “torture”. In the end, the introduction of the new article on torture in both departments considered excessive.
Previously, on 29 January it was reported that the FSB opposed the creation of the HRC in a single database on detainees.
The intelligence Agency has found that such a base will allow to obtain information about defendants in Affairs of third parties. In addition, as noted in the Department, access to data about detainees given to those who are interested in the outcome of criminal cases, including those implicated in crimes.
