District administrative court of Kyiv opened the case at the suit of the Ukrainian Orthodox Church (UOC) on forced renaming after creating a new Orthodox Church in Ukraine (PCU). About it reports a press-service of the court.
The claims of the UOC directed to the Ministry of culture of the country because of the law “On freedom of conscience and religious organizations”, according to which the Church ought to change its name and Charter in a limited time. The claim will be considered under the simplified procedure without notification of the parties to the case.
The law, according to which the UOC will have to change the name and the Charter was adopted in December 2018. He suggests that religious organisations need to be reflected in its full name that they are part of outside of Ukraine of religious unions. Expert management of Parliament, whose decision is not binding, came to the conclusion that the law contradicts the Constitution of the country.
In addition to the UOC, its name must change four organizations. Their actual names are unknown.
In April 2018, the President of Ukraine Petro Poroshenko officially accepted the Appeal for transmission to Patriarch Bartholomew on the granting of the Tomos of autocephaly signed by all the bishops of the schismatic organizations of the Ukrainian Orthodox Church-Kyiv Patriarchate and the Ukrainian Autocephalous Orthodox Church. UOC, part of the Moscow Patriarchate, opposed state intervention in the matter.
In September, the Synod of the Ecumenical Patriarchate in Constantinople took the heads of the UOC-KP and the UAOC anathema. In response, the ROC severed Eucharistic communion with Constantinople in October 2018, and the Synod of the UOC-MP called the Ecumenical Patriarch “to stop interfering in the internal Affairs of the Ukrainian Orthodox Church and not to violate its canonical territory.”
In January 2019 Patriarch Bartholomew granted autocephaly formed on 15 December 2018, the DNC, which included pre-existing non-canonical structure. The UOC-MP has refused to participate in the creation of the Autocephalous Church of Ukraine, calling the upcoming Unification Council “Council of the wicked.”
The ROC does not recognize the validity of signed Bartholomew Thomas.
