The Supreme court of Russia has submitted to the State Duma a bill to abolish the consideration of criminal cases for serious crimes in a specific order. A document signed by Supreme court Chairman Vyacheslav Lebedev, published on the website of the lower house of Parliament.
The bill proposes to amend the code of Criminal procedure, which allows to apply a special procedure of judicial proceedings only in cases of crimes small and average weight. In the explanatory note to the draft law States that in its original wording of article 314 of the criminal procedure code provided for the application of the special procedure for such cases. A special procedure was introduced for “procedural economy in cases of crimes, not representing to public danger”.
But then the law changed that allowed to pass sentences without trial in a General manner with the consent of the accused with the prosecution of a felony, punishable up to 10 years in prison.
According to official statistics, in 2018, in a particularly fine reviewed nearly 554 thousand criminal cases against nearly 580 thousand entities. these include criminal cases of serious offences in respect of 84 thousand persons, that is, 58 per cent of those accused of serious crimes.
Moreover, as noted by the Supreme court in the case of serious crimes usually are too difficult, affect the interests of many victims and cause resonance. It is therefore necessary to prescribe in law the guarantees of a fair justice, which is possible only if the proceedings in the General order in terms of immediacy and astnosti examination of evidence in court.
