Pechersk district court of Kyiv rendered a decision in favor of the oligarch Igor Kolomoisky, recognizing invalid the contract on his personal surety loan refinancing PrivatBank before the state entered its capital, the press service of the National Bank of Ukraine (NBU).
As indicated in the message, NBU is outraged by this decision and will seek its appeal.
In 2015 Kolomoisky, who at the time was co-owner of the Bank, concluded with the National Bank of the contracts of personal guarantee of repayment of five loans refinancing PrivatBank, which were concluded in the period from 2008 to 2014. “In fact, he assumed personal liability for repayment of the Bank debt to the NBU, which now stands at 9.2 billion hryvnia ($343 million)”, — stated in the message.
The lawsuit demanding to terminate the contracts of guarantee Kolomoisky filed in September 2017, the Pechersk court granted it. “The national Bank is concerned about the outcome of court cases in courts of first instance, because this decision is the third not in favor of the state for the last three days,” said the national Bank of Ukraine.
Earlier, permanent representative of the International monetary Fund (IMF) in Ukraine Jost Longman opposed the court decision, which invalidated the nationalization of PrivatBank, belonging to Igor Kolomoisky. He recalled that the IMF supported the reform of corporate governance PrivatBank, headed an independent oversight Board and the transformation of the business model of the Bank, which has positively influenced the stability of the banking system of Ukraine.
The President of Ukraine Petro Poroshenko before said that such a judgment could seriously harm relations with the International monetary Fund (IMF). In his opinion, the Bank’s return into the hands of Kolomoisky could derail the hryvnia exchange rate and trigger a new round of economic crisis in the country.
