In the state Duma a bill to increase the maximum penalty for failure to keep to the territory of Russia the personal data of the Russians. The document is published on the website of the lower house of Parliament.
The initiative made by the deputies of the faction “United Russia” Victor Pinsky and Daniel Bessarabov. Changes are proposed to article 13.11 of the code of administrative offences (Cao, Russia) dedicated to the violations in the field of personal data. The deputies proposed to add parts 8 and 9.
Not to store personal data of Russians in the country is proposed to punish by a fine for citizens in the amount from 30 thousand to 50 thousand rubles, for officials — from 200 thousand to 500 thousand rubles, and for legal entities — from 2 million to 6 million rubles.
At the same time for a repeated violation scheduled fines for citizens in the amount from 50 thousand to 100 thousand rubles, for officials — from 500 thousand to 1 million rubles, and for Uralic — from 6 to 18 million rubles.
In the explanatory Memorandum to the bill notes that earlier for failure to comply with requirements on the localization databases Russians punishment was not provided. In fact, the Internet company was prosecuted under another article about the failure to provide information (article 19.7 of the administrative code of Russia). The maximum penalty under this article for citizens ranges from 100 to 300 rubles, for officials — from 300 to 500 rubles, and for legal persons — from 3 to 5 thousand rubles.
In April according to this article in Russia was fined social networks Facebook and Twitter. They are ordered to pay 3 thousand rubles for failure to provide information about transferring to Russia servers with personal data of Russian users. The decision against Twitter was made on April 5 and against Facebook — April 12.
According to Russian legislation, courts that handle personal data of Russian citizens must store them on the territory of the country.
