A couple of mortgage borrowers from Chelyabinsk lost credit load, despite the fact that part of the debt was repaid at the expense of means of the parent capital. The Bank took mortgage housing non-payers, demanded of them further to pay him another 600 thousand rubles. This was reported on the website of the public movement “popular front” (onf).
According to the onf, the apartment is worth two million rubles was bought by the spouses in a mortgage with an initial payment of 500 thousand rubles. Family some time paid the loan and repaid the debt with funds of the parent capital.
Then the borrowers stopped paying on the loan, and the Bank foreclosed on their apartment. However, considering that the implementation of housing would be insufficient to repay the debt, the creditor tried to collect from debtors additional funds in the amount of 600 thousand rubles.
His wife turned to onf for assistance, as a result, they failed to challenge the requirement of the Bank in court and without the payment of additional amounts.
“Debt secured by the mortgage obligation is fully repaid if the debtor has taken the collateral housing. This applies even to those cases where the debt is greater than the proceeds from the sale of apartments amount (…) In practice, very often people and housing deprived, and still owe the Bank”, — commented the expert of the project onf Vyacheslav kurilin.
That banks should not continue to collect money from unscrupulous borrowers who have already lost purchased mortgage housing, said earlier the first Deputy head of the Central Bank Sergey Shvetsov. “We recommended banks to study such cases and take measures to eliminate violations, including the return of previously received payments”, — he stressed.
